Terms & Conditions


The following terms and conditions (Terms & Conditions) apply to all transactions processed by Giseke GmbH & Co. KG ("the Company"). All orders made are subject to the acceptance of these Terms & Conditions, and deemed to be accepted by you when placing your order. These Terms & Conditions do not affect your statutory rights. These terms and conditions are subject to change without notice and supersede all previous editions.


1. PAYMENT
1.A Each order for goods will be treated as an offer by you to purchase the goods subject to these Terms & Conditions. You are deemed to accept the Terms & Conditions when you place an order for goods with the Company. The Company's contract with you only begins when the Company confirms acceptance of your offer to purchase goods from the Company. An order will not take place (and the Company will not be deemed to have accepted your order) until the Company has validated and confirmed your payment. Any communication received from the Company prior to validation, is not to be deemed as an acceptance of your order. In the event of any pricing error on the Company's website, within a written or verbal quotation, or contained in any fax or e-mail correspondence however received, respective orders shall be deemed void.
1.B All major credit cards, UK cheques, wire transfer & BACS payments are accepted. Electron cards are not accepted. Official purchase orders from Government, Education, Healthcare and other Corporate customers are accepted at the Company's sole discretion.
1.C All cheque, BACS, and wire payments must be cleared before any goods can be dispatched. Purchase Orders should be faxed to 07050 687-201. No goods will be dispatched until receipt of the original order.
1.D Whilst the Company endeavours to publish as much information as is practical about the goods, the descriptions of the goods are as set out on the website. All drawings, photographs, descriptive matter, colour, specifications and advertising on our website pages are for the sole purpose of giving an approximate idea of the goods. They will not form part of the contract between you and the Company.
1.E Ownership of the goods shall not pass to you until the Company has received payment in full (in cash or cleared funds).
1.F Orders for goods are subject to stock availability. If the Company does not supply goods to you for any reason you will be informed of the situation and you will not be charged for those goods, and you will be refunded any money already paid by you for these goods. The Company is not liable for any financial loss incurred by you relating to interest payments, or loss of earnings, or similar gains you would have received on monies paid to the Company in lieu of any unfulfilled order.
1.G All prices quoted or displayed are in UK pounds sterling (GBP) and shall be the price inclusive of VAT but exclusive of delivery, set out on the website at the time your order is placed. A delivery charge will be made and clearly shown in the orders section of the shopping cart before any online order can be placed, or as displayed on the Company's website, or as quoted by phone. The Company is entitled to make adjustments to the price to take account of any increase in, or the imposition of any new taxes or duties. If due to an error or omission the price published for the goods on the Company's website is wrong the Company has the right to terminate an order provided the goods have not been dispatched. The Company will try to ensure that all prices displayed on the Company's website are accurate. Should an error occur the Company would inform you of the correct price and give you an opportunity to cancel the order.
1.H Payment for goods must be made in accordance with the Company's purchase procedure as set out on the Company's website. All orders are positively credit card sanctioned prior to dispatch. The Company can accept no responsibility if any details you provide the Company with that are incorrect. The Company can accept no responsibility if any order is held up as a result of incorrect or unsubstantiated details.
1.J Any clerical error or omission in any sales literature, quotation, pricing on the website, acceptance of offer, invoice or other document or information issued by the Company shall be subject to correction without any liability on the part of the Company.
1.K The Company shall not be liable to you for any loss whatsoever relating to password or user name access to your account. It is your responsibility to protect your own password and or user name. Unless informed by you in writing as to the opposite the Company will consider any e-mail address given by you is indeed your own personal account and is secure. The Company takes no responsibility for any third party abuse of your e-mail account.


2. WARRANTY
2.A All new goods are sold with a 6-month manufacturers guarantee.
Full warranty details are available from the Company's customer services team.
If the Company is unable to effect a repair or replacement the Company will offer you a full refund. It is your responsibility to return any faulty used product back to the place of purchase (as advised by the Company) at your own expense, whereupon these goods will be repaired or replaced and shipped back to you free of charge, should a fault occur.
2.B If these goods are deemed tampered with in any way your warranty will become void and you will become responsible for the costs of repair and return shipping. If no fault is found you will be responsible for the costs of repair and return shipping. Wherever possible the Company will respond to your individual circumstances. The Company will not be liable for any transit damage that may occur on any product you have returned to the Company for repair. The Company strongly suggests that you make sure you have used sufficient packaging to protect your product and insure against damage before returning any product for repair. For advice on how to pack your goods safely before return please contact the Company's customer services team.
2.C The warranty does not cover, accidental damage, modifications to, failure(s) not due to manufacturing defect(s). The Company cannot be held responsible for any costs arising from unauthorised repairs to equipment during the warranty period. Only the Company or the equipment manufacturer or their authorised service agents can carry out any warranty work. Any unauthorised repairs or repair attempts will void the warranty.
2.D In the event of product failure the Company is not responsible for the loss of any data that may occur.


3. DELIVERY
3.A The delivery address will be that registered with your order, unless you request otherwise and the Company agrees to such a request (at the Company's sole discretion).
3.B The Company will endeavour to deliver your goods if in stock within 1-3 working days (with the exception of weekends & public holidays) but time shall not be of the essence. If the Company is unable to deliver the goods for any reason you will be notified and will not be obliged to pay for the goods. If delivery of the goods is delayed by more than 30 days, you shall be entitled to contact the Company and cancel the order. Any monies paid in respect of goods, which are not delivered, will be refunded.
3.C Goods, other than faulty goods, may not be returned after 7 days unless the Company agrees that there is good reason to receive such goods back. If the Company agrees to accept these goods back into stock they are subject to a 15% re-stocking fee. The Company recommends that you make full use of our sales team for advice prior to purchase.
3.D The Company must be notified within 48hours of delivery if any part of your order is missing, damaged or incorrect. The Company will not accept any responsibility after this time period.
3.E The Company will deliver to alternative addresses at your request but please note that if instructed to do so, you are agreeing that anyone situated at your alternative address has your written authority to accept goods on your behalf. The Company will accept no responsibility for goods once they have been delivered to and signed for at the requested address.
3.F Delivery charges are displayed in the shopping basket, or on the page called shipping, or via our sales team. Delivery charges depend on the final destination of delivery and payment method.
3.G The Company is not liable for direct or consequential loss; damage arising from any delay in delivery will not be accepted by the Company.


4. RETURNS & REFUNDS
4.A The Company will provide a full refund (excluding delivery charges) if the product you have selected is found to be unsuitable within 7 working days following delivery. Please contact our customer services department for a return authorisation code on fax 07050 687-201 or via email customerservices@battery4laptop.co.uk. The return authorisation code must be labelled on the product you are returning. Items received without authorisation will be returned directly. Refund of the product will be accepted provided it is returned in its original box, in 'as new' and unmarked condition complete with all packaging and /or accessories supplied.
4.B You shall not be entitled to a refund or replacement of damaged goods if the defect arises because you fail to follow the manufacturers instructions as to use, installation, commissioning or maintenance of the goods, or you alter or repair such goods without our written consent.

5. MISCELLANEOUS
5.A The Company shall not be liable to you for any failure or delay in performance of our contract. If it is due to an event beyond our reasonable control including, without limitation, acts of God, war, industrial dispute, fire, flood, tempest and national emergencies and if so delayed the Company shall be entitled to a reasonable extension of time for performing such obligations.
